Conclusion of Contract

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is instead a non-binding invitation for the consumer to order goods. By placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) When an order is received in our online shop, the following rules apply:
The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order process includes the following steps:

  1. Selection of the desired goods

  2. Confirmation by clicking the “Order” button

  3. Review of the information in the shopping cart

  4. Clicking the “Checkout” button

  5. Selection of payment method

  6. Review and correction of entered data

  7. Binding submission of the order by clicking the “place order” or “buy” button

Before submitting the order bindingly, the consumer can return to the page where their details were entered to correct errors by using the “Back” button in their browser or cancel the ordering process by closing the browser window.
We confirm receipt of the order immediately via an automatically generated email (“Order Confirmation”). This email constitutes acceptance of your offer.

We send the order details and our Terms & Conditions to you via email. You can access the Terms & Conditions at any time at https://atyra.de/agbs.
For security reasons, your order details are no longer accessible online.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices stated include the statutory VAT and all other price components. Any applicable shipping costs are added.

(2) Consumers may pay by advance payment, direct debit, PayPal, or credit card (Visa, Mastercard, American Express).

(3) If the consumer selects advance payment, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered are ready for immediate dispatch. Delivery takes place no later than within 7 business days.
The delivery period begins the day after the payment order is issued to the bank (for advance payment) or the day after the contract is concluded (for all other payment methods).
If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the goods passes to the buyer only upon handover, even in the case of a shipment purchase.

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.

§6 Right of Withdrawal for Consumers

Consumers have the following right of withdrawal.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

Return shipments should be sent within three days after registering the return.

by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract.
You must use the attached sample withdrawal form.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs arising from choosing a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day we receive your notice of withdrawal.

For this refund, we will use the same payment method you used in the original transaction unless expressly agreed otherwise; in no case will you be charged fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs earlier.

You must return the goods without delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal. The deadline is met if you dispatch the goods before the fourteen-day period expires.

You bear the direct cost of returning the goods.
