Terms and Conditions of ATYRA GmbH

§1 Scope and Definitions

(1) The following Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB).

§2 Conclusion of Contract and Storage of Contract Text

(1) The following regulations regarding the conclusion of a contract apply to orders placed through our online shop at
https://atyra.de.

(2) In the event of a contract being concluded, the contract is formed with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer, but rather a non-binding invitation for consumers to place an order. By ordering the desired goods, the consumer submits a binding offer to enter into a purchase contract.

(4) When an order is placed in our online shop, the following rules apply: the consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order process includes the following steps:

  1. Selection of the desired goods

  2. Confirmation by clicking the “Order” button

  3. Checking the information in the shopping cart

  4. Clicking the “Checkout” button

  5. Selecting the payment method

  6. Reviewing and correcting the entered data

  7. Binding submission of the order by clicking the “place order” or “buy” button

Before the binding submission of the order, the consumer may return to the page on which their details were entered and correct any errors by using the “back” button in their internet browser. They may also cancel the order process by closing the browser window.

We confirm receipt of the order immediately via an automatically generated email (“Order Confirmation”). This email constitutes acceptance of your offer.

(5) Storage of the contract text for orders via our online shop:
We will send the order details and our Terms & Conditions to you via email. You can view the Terms & Conditions at any time at https://atyra.de/agbs.
For security reasons, your order details are no longer accessible online after completion.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and all other price components. Shipping costs may apply.

(2) Consumers may pay by advance payment (bank transfer), direct debit, PayPal, or credit card (Visa, Mastercard, American Express).

(3) If the consumer selects advance payment, they are required to pay the purchase price immediately upon conclusion of the contract.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery shall take place within 7 business days.
For advance payment, the delivery period begins on the day after the payment order is issued to the transferring bank; for all other payment methods, the period begins on the day after the contract is concluded.
If the last day of the delivery period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.

(2) The risk of accidental loss and accidental deterioration of the goods shall transfer to the buyer only upon handover, even in the case of a shipment purchase.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been received.

§6 Right of Withdrawal for Consumers

Consumers have the right to withdraw from this contract under the following conditions.
A consumer is any natural person who enters a legal transaction for purposes that predominantly are outside their trade, business, or profession.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g. a letter sent by post, email) of your decision to withdraw from this contract.
You may use the withdrawal form provided below, but it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from choosing a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive your notification of withdrawal.

For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise. You will not be charged any fees for this refund.

We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal. The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You bear the direct cost of returning the goods.
